Civic issues
Topics getting the most attention in Montgomery County public meetings, ranked by how frequently they come up.
Long-term solid waste disposal
The county must decide whether to close the Dickerson incinerator by January 2027 and truck waste to out-of-county landfills, or spend an estimated $356 million refurbishing it. Environmental justice, truck traffic, and composting capacity are all in play; a decision is targeted for this fall.
Forest conservation law applicability and brush management
Farmers currently need Planning Department pre-approval for routine brush management even when they already have a Soil Conservation District plan — a redundant, time-consuming step. Bill 35-26 removes that requirement, speeding up work in the Agricultural Reserve.
Gude Landfill long-term lease
Part of the old Gude Landfill in Rockville would be leased long-term to Community Power Group LLC; a public hearing comes October 13.
Septic system maintenance and the pump-out rebate pilot
With roughly 20,000 septic systems countywide and far fewer pump-outs happening than recommended, DEP is launching a $100 rebate (up to a third of a typical $300-400 pump-out) as a pilot, with 400 rebates a year and postcard outreach planned.
Clarksburg Road Sewer Connection for Assisted Living Facility
A property owner wants public sewer for a proposed assisted living center at 21820 Clarksburg Road, but the Friends of Ten Mile Creek say it would break master plan protections for a pristine watershed and set a precedent for 15 other RE-1 parcels.
Solar Collection System Standards
State law now preempts county zoning for solar projects under one megawatt. The committee updated county rules to match, making rooftop solar notably easier by cutting setback and screening requirements.
Data center moratorium bill
The committee moved to define and then ban data centers drawing 25+ megawatts from every zone in the county, pairing with an 18-month moratorium to buy time for study. The stakes: energy demand on the grid, water use for cooling, noise, and pressure on the Agricultural Reserve.
PFAS contamination and well-water safety
'Forever chemicals' were found at elevated levels near the former public safety training academy, likely from old firefighting foam. Free well testing is offered within a mile, and Councilmember Balcombe wants a comprehensive county system for testing private wells — especially after Poolesville's water tested positive.
Solar rules on farmland and rooftops (ZTA 26-07)
The zoning change would loosen requirements for rooftop solar and clarify which solar facilities are exempt from local zoning under state law — a farmer testified it could help farm businesses earn revenue without taking land out of production.
Green Bank fuel-energy tax amendments
Bill 2-26 would remove a statutory restriction on how the Montgomery County Green Bank can spend fuel-energy tax revenue. Lifting it opens the door to a wider pipeline of climate resilience projects across the county.
Green Bank climate funding expansion
The Green Bank, which leverages $4 in private capital per county dollar for solar and energy-efficiency projects, saw $2 million of its increase sent to the reconciliation list — a painful but manageable cut, per its CEO.
Future of the Resource Recovery Facility (incinerator)
The Council kicked the incinerator close-or-keep decision out of the budget and into a fall worksession, funding current operations for FY27 and requiring Council approval before any contracts change the county's solid waste approach. DEP warns delay raises long-haul trucking and composting costs.
Roadside tree protection funding
Following a public hearing, the Council adopted $100,050 from the Street Tree Planting Fund to protect roadside trees.
